EagleCast TV maintains this policy to provide copyright owners and authorized representatives with a clear, structured process for submitting notices, supplying evidence, and responding to copyright-related issues.

1. Policy Overview and Purpose

EagleCast TV respects copyright and other intellectual property rights. This policy explains how EagleCast TV receives, evaluates, and responds to copyright complaints concerning material or activity that a rights holder believes infringes copyright.

This procedure is designed to provide a clear and orderly channel for rights holders and authorized representatives. Where Section 512 of the U.S. Copyright Act applies to the relevant service activity, EagleCast TV follows the notice-and-counter-notice framework established by federal law.

A copyright complaint is an allegation, not automatically a finding of infringement. EagleCast TV reviews the information supplied, may request clarification, and takes action where appropriate under applicable law and the circumstances of the matter.

3. How to Submit a Copyright Notice

Send copyright complaints to support@eagle-cast.tv. Put “DMCA Copyright Notice” in the subject line when possible.

To help EagleCast TV locate and evaluate the complaint efficiently, the notice should contain the information required by applicable law and enough detail for the allegedly infringing material to be identified without guesswork.

Required elements for a statutory notice

  1. A physical or electronic signature of the copyright owner or a person authorized to act for the owner.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, a representative list may be used where permitted.
  3. Identification of the material or activity claimed to be infringing, together with information reasonably sufficient to permit EagleCast TV to locate it.
  4. Contact information sufficient to permit communication, such as name, address, telephone number, and email address.
  5. A statement that the complaining party has a good-faith belief that the challenged use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury where required, that the complaining party is authorized to act for the copyright owner.

4. Review, Verification, and Response

When EagleCast TV receives a copyright complaint, the complaint may be reviewed for completeness, clarity, and apparent applicability. EagleCast TV may request additional information where the notice does not identify the work, challenged material, authority, or factual basis with sufficient precision.

Where applicable and appropriate, EagleCast TV may remove, disable, restrict, or otherwise address access to material or activity identified in a compliant notice. The specific response depends on the nature of the complaint, the service involved, the information available, and applicable law.

EagleCast TV does not promise a particular response time for every complaint. Statutory standards such as “expeditiously” may apply in circumstances governed by Section 512.

5. Counter-Notification Procedure

If material was removed or access was disabled following a copyright complaint and the affected party believes the removal resulted from a mistake or misidentification, that party may submit a counter-notification where the applicable law provides that procedure.

A compliant counter-notification generally includes

  1. The counter-notifying party’s physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
  3. A statement, under penalty of perjury where required, that the party has a good-faith belief the material was removed or disabled because of mistake or misidentification.
  4. The party’s name, address, and telephone number.
  5. A statement consenting to the jurisdiction specified by applicable law and acceptance of service of process from the person who submitted the original notification or an agent of that person.

When a compliant counter-notification is received, EagleCast TV may forward it to the original complaining party as required by applicable law. Where the statutory process applies, restoration can be subject to the applicable waiting period and to whether EagleCast TV receives notice of a court action.

6. Repeat-Infringer and Abuse Controls

EagleCast TV may take proportionate action against accounts, users, submissions, or other activity associated with repeated or serious intellectual-property violations, subject to applicable law and the facts of the matter.

Examples of conduct that may result in restrictions include repeated infringement after prior notices, deliberate circumvention of restrictions, knowingly submitting materially false information, or using the copyright process to harass another party.

7. False Notices and Misrepresentation

Copyright notices and counter-notifications are legal communications. Parties submitting them should ensure that statements are accurate, complete, and made by a person authorized to act.

Applicable law may impose liability for material misrepresentations made in a copyright notice or counter-notification. EagleCast TV may preserve relevant communications and records when necessary to investigate suspected abuse of the process or respond to legal claims.

8. Other Intellectual-Property Complaints

Trademark, publicity, privacy, impersonation, contractual, and other non-copyright complaints may require different procedures. A message should clearly identify the legal right being asserted and the specific material or conduct at issue.

Where a complaint is not a DMCA matter, EagleCast TV may route or handle it under the applicable internal process or applicable law rather than treating it as a statutory DMCA notice.

9. Records, Privacy, and Communications

EagleCast TV may retain copyright complaints, counter-notifications, correspondence, attachments, and related records for legitimate business, compliance, security, dispute-resolution, and legal purposes.

Information submitted through a copyright process may be shared with relevant parties where necessary to evaluate the complaint, process a counter-notification, comply with law, protect rights, or respond to legal proceedings. Personal information is handled in accordance with the EagleCast TV Privacy Policy.

10. Section 512 and Safe-Harbor Limitations

Section 512 establishes limitations on liability for qualifying service providers when statutory requirements are satisfied. Eligibility is not automatic merely because a website publishes a DMCA policy. The applicable statutory conditions depend on the provider’s activities and compliance with the relevant requirements.

EagleCast TV does not use this policy to expand or guarantee any legal protection beyond what applicable law provides. Nothing in this policy limits a rights holder’s rights under applicable copyright law.

11. Policy Changes and Contact

EagleCast TV may update this DMCA Policy when its procedures, services, legal obligations, or operational practices change. The “Last Updated” date at the top of this page identifies the current version published by EagleCast TV.
